Welcome to Melodial! The terms “we,” “us,” and “our” refer to Melodial. Melodial operates this website and service platform (the “Services”), including all related features, tools, products, and content. Melodial is powered by Shopify, enabling us to provide these Services to you.

These Terms of Service (“Terms”) outline your rights and responsibilities when using the Services. By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your jurisdiction and have authorized any minor dependents to use the Services through your devices.

All prices are subject to change without notice. Final prices will appear at checkout. Prices may differ from those in physical or third-party stores.

You agree to provide complete and accurate payment details and authorize us to charge your card for all purchases, including applicable taxes and fees.

SECTION 5 – DELIVERY OF DIGITAL SERVICES

Melodial offers digital services such as streaming subscriptions and downloadable on-hold messages. These services are delivered electronically and do not involve physical shipping.

We are not responsible for delays caused by third-party email systems, incorrect email addresses, or customer-side issues.

SECTION 6 – AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

  • Cancel your service and receive a refund for a major failure

  • Choose a refund or replacement for goods with a major fault

  • Have minor issues corrected within a reasonable time

SECTION 7 – INTELLECTUAL PROPERTY

All content and branding on the Services are owned by Melodial or its licensors. 

Unauthorized use of any material may infringe copyright or trademark laws.

SECTION 8 – OPTIONAL TOOLS

We may provide access to tools or integrations from third parties. We are not responsible for their content or function and provide no warranties.

You use these tools at your own risk and should review their terms before use.

SECTION 9 – THIRD-PARTY LINKS

The Services may contain links to third-party sites. We are not responsible for their content, services, or data practices. Accessing these is at your own risk.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Melodial is powered by Shopify. However, your agreement is with Melodial. Shopify is not liable for any issue arising from your transactions with us.

SECTION 11 – PRIVACY POLICY

We collect and use your data per our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you consent to this data usage.

Your data may be processed in countries outside your own, as required to deliver the Services.

SECTION 12 – FEEDBACK

By submitting any feedback or reviews, you grant us the right to use, display, and modify it without obligation. You confirm that your content does not infringe any third-party rights or contain harmful material.

SECTION 13 – ERRORS AND INACCURACIES

We reserve the right to correct errors or omissions and to cancel or update orders if information is inaccurate, even after the order has been placed.

If any provision of these Terms is found to be unlawful or unenforceable, the remainder shall remain in effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Failure to enforce any right does not waive it. These Terms, including referenced policies, form the entire agreement between you and us.

You may not assign your rights under these Terms without our consent. We may assign our rights at any time.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the jurisdiction of the courts in that state.

Headings are for convenience only and do not affect interpretation.
